In 2010, the US Supreme Court ruled in Padilla v. Kentucky, that criminal defense counsel had the duty and obligation to explain the immigration consequences of criminal proceedings against a defendant. Failure to do so amounts to ineffective assistance of counsel in violation of the client's rights. This CLE will inform participants of their obligation as counsel under Padilla and offer information on how to give accurate advice and how to avoid adverse immigration outcomes.
