We will discuss what to do when a defendant has contraband and wants it to be returned. We will look at scenarios where the defendant was found guilty or not guilty and how this impacts the ability of the return of certain items. We will also address what to do when the items are owned by someone other than the defendant and what to do when that person wants an item returned. For example, we will look at a scenario where the defendant was carrying someone else’s legally registered gun or a defendant was charged with DWI, but was driving someone else’s car and the car was impounded. What laws and policies allow the items to be returned to the rightful owners?
