If there is any question about the witness/defendant’s competence, the lawyer must inquire. Lawyers are required to insure their clients are competent. We must explore the best way to determine competence and then what we can and should do when the person does not appear to be competent. Can the court inquire on its own into competence? Can the court make this inquiry even against the defendant’s objection? We will explore these various scenarios.
