When the defendant is found to be in violation of a court order, there are civil and criminal remedies that are available. We will explore when certain remedies are available and they can and should be used. We will look at cases where attorneys have argued that the failure to comply was not willful. How can and should the court respond to this argument? What remedies are available to the defendant when he is in non-compliance with an order?
